Clay County Circuit and Superior Courts

Indiana uses circuit courts, superior courts, and certain local courts where authorized. For Clay County, the practical public trial courts are Clay Circuit Court and Clay Superior Court. The courts sit in the Clay County Courthouse at 609 East National Avenue in Brazil. The County Clerk is in Room 209, Superior Court is in Room 203, and Circuit Court is in Room 314. This room-level setup matters because a person may appear in one room for court, then request a file, certified copy, judgment entry, or marriage record from the Clerk in another room.

Circuit vs Superior vs Local Courts

Clay County's court comparison is not a district-court, county-court, and justice-court split. The State Court Structure Map says no official Clay city or town court record source was located, and traffic plus ordinance cases are assigned to Clay Superior Court under local rules. Clay County Case Flow

Case flow in Clay County depends on the case type. A felony may be allocated between Circuit and Superior Court under the local criminal assignment rules. A misdemeanor, traffic infraction, ordinance violation, adult protective order, or small claim is more likely to route through Superior Court. Clay County Court Assignments

The current Clay local rules effective January 1, 2026 give a detailed assignment plan. Murder, Level 1 through Level 4 felonies, and older A, B, or C felony designations are allocated between Circuit and Superior Courts, except felony operating-under-the-influence and driving-above-legal-limit cases are not filed in Circuit Court. Level 5 and Level 6 felonies and older D felonies are also equally allocated, again with OWI and BAC exceptions.

Misdemeanor cases go to Clay Superior Court if misdemeanor is the highest charge. Miscellaneous criminal and criminal red flag cases are equally assigned between Circuit and Superior. Traffic infractions and ordinance violations are assigned to Superior Court. Juvenile cases, estates, guardianships, trusts, and adoptions are assigned to Circuit Court. Mortgage foreclosure, eviction, civil collection, dissolution, grandparent visitation, miscellaneous civil, court business, mental health, civil red flag, and judicial review are generally equally assigned unless a local-rule exception applies.

Clay County Courthouse

The courthouse is central to Clay County Circuit and Superior Courts because it houses the Clerk, Superior Court, Circuit Court, Prosecutor, child support office, juvenile probation, and several other county record offices. Clay County Court History

Clay County's present courthouse is the fifth county courthouse. The Indiana Historical Bureau marker says it was designed by John W. Gaddis of Vincennes in Classical Revival style and built from 1912 to 1914 of limestone. Interior features include a central rotunda with stained-glass skylight, marble wainscoting, granite columns, and inlaid tile floors. The skylight was restored and four tower clocks were installed in 1986.

The courthouse was listed in the National Register of Historic Places in 1999, and the historical marker was installed in 2001. For court records, the history point is continuity. Clay County court records moved from paper books, judgment dockets, and permanent historical records into modern systems, but MyCase and Odyssey do not replace the Clerk. Older records, non-linked documents, and certified copies still route through the County Clerk.

Clay County Appeals Path

Final judgments and appealable orders from Clay Circuit Court or Clay Superior Court normally go to the Court of Appeals of Indiana. The Clerk's responsibilities page says the Clerk prepares or approves Records of Proceedings for appeal to the appellate and supreme courts. The Indiana Supreme Court may accept transfer or handle matters assigned by constitution, statute, or rule.

Federal cases from Clay County are separate from local trial-court records. Clay County is in the U.S. District Court for the Southern District of Indiana, Terre Haute Division, and federal appeals go to the U.S. Court of Appeals for the Seventh Circuit. PACER and federal CM/ECF are separate from Clay County Clerk records.

That split is important during a records search. A Clay County felony, divorce, small claim, probate matter, or traffic infraction belongs in the local court and Clerk system. A federal civil rights case, federal criminal case, bankruptcy matter, or federal appeal uses federal court systems instead. The court name on the notice or docket is the best clue.
